    LACOSTE LOYALTY PROGRAM

    GENERAL TERMS AND CONDITIONS FOR LACOSTE Loyalty Program Membership


    1. You can become a member of the LACOSTE Loyalty Program at any time by completing the Online Registration Form To register, you will need to provide personal information: first name, last name, mobile phone number, e-mail address and date of birth.
    2. Membership in the LACOSTE Loyalty Program is available to persons 18 years of age or older.
    3. Membership in the LACOSTE Loyalty Program is exclusively assigned to a specific person; only the person registered as a Program Member can obtain the benefits associated with the membership account and cannot transfer these benefits to other persons.
    4. Devanlay Polska Sp. z o.o. reserves the right to refuse membership to a person who does not meet the criteria set out in the terms and conditions of the Program.
    5. All persons interested in participating in the LACOSTE Loyalty Program are deemed to have read and accepted the Program regulations. During registration, links to the Regulations and Privacy Policy are provided, acceptance of which is required to join the program.
    6. Membership in the Program may be cancelled at any time.
    7. These general terms and conditions are subject to change.



    2. BENEFITS


    Membership in the LACOSTE Loyalty Program entitles you to certain benefits and promotions, including, in particular, the right to take advantage of offers prepared exclusively for Loyalty Program Members.


    Members will be notified of upcoming or ongoing benefits, discounts and promotions and their duration, as the case may be, by text message / email, traditional mail, unless they have indicated that they do not wish to receive these notifications. 


    3. WITHDRAWAL OF CONSENT



    Any LACOSTE Loyalty Program Participant may withdraw consent to the further processing of his/her personal data and leave the Loyalty Program at any time. The simplest way to do this is in one of the following ways.

    1. Through a link provided in the newsletter, which redirects the customer to a website that automatically orders unsubscription from the Loyalty Program.
    2. By sending an e-mail to: gdpr@lacoste.pl,, including the following text in the title of the e-mail message: "Withdrawal of consent to participate in the Loyalty Program", and in the body of the message your name and the telephone number you provided at registration.

    5. MISCELLANEOUS 

    Devanlay Polska Sp. z o. o. reserves the right to withdraw benefits and promotions at any time. 

    Membership in the LACOSTE Loyalty Program, and any benefits derived from it, are not exchangeable for cash, nor do they confer a right to receive cash. Promotions cannot be combined with other promotions. 


    6. DATA PROTECTION 

    At Devanlay Polska Sp. z o.o. we protect your personal data.

    All personal data collected through membership in the LACOSTE Loyalty Program will be used and shared exclusively for the purpose of communicating Devanlay Polska Sp. z o.o. with Program Members, in order to send messages regarding products and events. 

    Devanlay Polska Sp. z o.o. processes and is responsible for the processing of the personal data of LACOSTE Loyalty Program Members, in accordance with the applicable national data protection regulations.

    We kindly confirm that by joining the Lacoste Loyalty Program you have agreed to:


    1. receive marketing/trade material concerning the activities of Devanlay Polska Sp. z o.o., including receipt of information on current promotions and trade offers via text messages or e-mail;


    1. receive electronically commercial information within the meaning of the Act of 18 July 2002 on the provision of electronic services with marketing content from Devanlay Polska Sp. z o.o.;


    1. the use by Devanlay Polska Sp. z o.o. of telecommunications terminal equipment and automatic calling systems for direct marketing purposes, within the meaning of the Telecommunications Act of 16 July 2004;

    Your Personal Data will be processed by us for the following purposes: (i) to enable you to receive information about new services or products offered by the Controller by e-mail, text message and traditional mail; (ii) to conclude a sales agreement taking into account the terms and conditions of the Loyalty Program currently in force; (iii) to fulfil the Controller's legal obligations and rights arising therefrom, e.g., analytical duties concerning trade statistics, improvement of the quality of the services offered, archiving related to the protection of the Controller's legal interests (e.g., the assertion of claims, protection against unlawful actions to the Controller's detriment).


    The processing of your personal data will take place on the basis of Article 6(1)(a) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, i.e., your freely given consent. 


    The processing of your personal data will take place on the basis of Article 6(1)(b) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, i.e., for the purpose of concluding a sales agreement using the benefits of the Loyalty Program. 


    The processing of your personal data will take place on the basis of Article 6(1)(c) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, i.e., the processing is necessary for the performance of obligations incumbent on us such as, for example, for the purpose of financial and tax accounting. 


    The processing of your personal data may take place on the basis of Article 6(1)(f) of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016, i.e., on the basis of the legitimate interest of the controller, e.g., for the purpose of being able to assert and defend against your claims. 



    We may provide your Personal Data to entities in the group of companies to which Devanlay Polska Sp. z o.o. belongs and to other entities that help us run our website and applications, including marketing campaigns (e.g., support us in sending e-mails or text messages), provide support for our IT tools and systems (e.g., maintain our software, store our data) and to our legal and advisory service providers. 


    Your Personal Data may be transferred outside the European Economic Area only to the extent necessary in connection with the provision of services, especially IT services, by these partners to us.     Your Personal Data will be kept for the period necessary for the specific processing. 


    Your Personal Data processed for the purposes of direct marketing of products and services will be processed by us until you revoke your freely given consent, unless we are obliged by law to continue to process your Personal Data or we retain it for potential claims. 


    Certainly, the data will be processed for the duration of the sales agreement between us, using the benefits of the Loyalty Program, as well as for the duration of the maturity of any claims related thereto, and for a period no shorter than that required by law, including in particular the provisions of the Tax Acts and the Accounting Act.


    Your personal data will be processed in a partially automated manner, as we will process it to some extent on computer resources. We may use methods involving automated decision-making, including profiling, as part of our data processing.
